1. Acceptance of Terms

By downloading, installing, or using the TradingBuddy application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Carterware ("Company," "we," "us," or "our"), the developer and operator of TradingBuddy.

2. Description of Service

TradingBuddy is a cryptocurrency trading platform that provides:

  • AI-powered market analysis and trading signals
  • Automated trading bot functionality
  • Portfolio tracking and management tools
  • Educational content and trading resources
  • Risk management features

The App integrates with third-party cryptocurrency exchanges through API connections to facilitate trading activities.

3. User Eligibility

To use TradingBuddy, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into contracts
  • Not be prohibited from using the service under applicable laws
  • Comply with all local, state, and federal regulations regarding cryptocurrency trading

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Trading and Financial Risks

IMPORTANT RISK DISCLOSURE: Cryptocurrency trading involves substantial risk of loss. You acknowledge that:

  • Past performance does not guarantee future results
  • Trading signals and AI analysis are not guaranteed to be profitable
  • You may lose some or all of your invested capital
  • Market conditions can change rapidly and unpredictably
  • Automated trading bots may not perform as expected

You should only trade with money you can afford to lose and should consider seeking independent financial advice.

6. Subscription and Payment Terms

TradingBuddy offers both free and premium subscription plans:

  • Free plans have limited features and functionality
  • Premium subscriptions are billed monthly or annually
  • Payments are processed through the App Store
  • Subscriptions auto-renew unless canceled
  • Refunds are subject to our refund policy and App Store terms

We reserve the right to modify subscription prices with 30 days' notice.

7. Intellectual Property

The App and all content, including but not limited to software, algorithms, text, graphics, and logos, are owned by Carterware and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

8. Prohibited Uses

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to reverse engineer or modify the App
  • Share your account credentials with others
  • Use the App to manipulate markets or engage in fraudulent activity
  • Interfere with the App's operation or security
  • Violate any applicable laws or regulations

9. Third-Party Integrations

TradingBuddy integrates with third-party cryptocurrency exchanges and services. We are not responsible for:

  • The availability or performance of third-party services
  • The security of third-party platforms
  • Any losses resulting from third-party service failures
  • Changes to third-party APIs or terms of service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTERWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOST PROFITS, OR DATA LOSS.

Our total liability to you for all claims shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability and fitness for a particular purpose
  • Accuracy of trading signals or market analysis
  • Uninterrupted or error-free operation
  • Security of data transmission

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, including if you violate these Terms.

Upon termination, your right to use the App ceases immediately, and you must delete all copies of the App from your devices.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website.

Your continued use of the App after changes constitutes acceptance of the new Terms.
